Special Immigrant Juvenile Status (SIJ)
There is a program for unaccompanied minors called the Special Immigrant Juvenile Status (SIJ) for children who have been abandoned, abused or neglected by either one of their parents or both.
It is a three step process that begins in State Court, where first guardianship is granted to either the non-abusive parent or to another friend or relative.
That order is then applied to the I-360 form with USCIS that gives the child a priority date to get their green card and establish permanent residency.
This is a very common relief option for unaccompanied minors who may or may not be in deportation proceedings.
The most significant downside is that a child who is approved for a SIJ Visa may not petition for their parents later on in life.
