On June 17, President Biden announced the Keeping American Families Together, and we couldn’t be more thrilled. This new process is designed to help families of mixed status, where one spouse is a U.S. citizen and the other is undocumented. Below, we explain how this initiative can benefit you and what steps you need to take to take advantage of it.

Overview of the Keeping American Families Together

This initiative aims to streamline the process for undocumented spouses and children of U.S. citizens to obtain legal status without the lengthy and risky procedures currently in place. Typically, the process can take up to five years and involves no work permission or protection against deportation. However, with this new executive order, there’s hope for a faster and safer path to legal status.

Consult with an Immigration Lawyer: It’s crucial to seek advice from a trusted immigration attorney. Avoid “notarios” and unqualified advisors.

Gather Your Documents: Start collecting all necessary civil documents such as marriage licenses, birth certificates, passports, and any other relevant documents.

Proof of Physical Presence: You’ll need to provide evidence of the immigrant spouse’s physical presence in the U.S. for the last ten years. This includes school records, medical records, work history, rent payments, and more.

Arrest Records: If there have been any arrests, gather all related records and certified court dispositions.

Financial Preparation: Prepare for the filing fees and legal costs. This is a potentially temporary program, so immediate action is recommended.
