You are receiving this email because you have received a Request For Evidence (RFE) from immigration.

This is no reason to panic —it happens a lot and it is a very routine practice. What this RFE means is that the officer that is looking at your application needs a little bit more information about your case before they can make a determination.

This does not always mean that we forgot something, or that we didn’t ask you for all of the evidence that we needed to ask you for. Sometimes it means that we submitted it, it got to the mailroom, but then it got lost between the mailroom and the actual officer who is going to be in charge of your case. It happens.

What your Legal Team does need in order to be able to figure out how to help you go forward, is a copy of the actual RFE letter. Sometimes, this letter gets to you before it gets to us. If this happens and you receive the letter before we do, please send the letter to our office. You can take a clear picture of it and send it via text or email.

This way, your Legal Team is able to see what items USCIS is requesting from us and what the deadline to respond is.

Once we get a picture of your RFE, your attorney will review it and come up with an action plan, and then your Legal Team will be reaching out back to you within a week to tell you what it is we need.

Perhaps we will need additional documents, or maybe we already have all of the documents we need because we submitted it the first time around, and we just need to re-submit them again.

There is a possibility that there will be an additional charge, especially when the RFE is asking us to submit an entire new application, or a whole new form for one reason or another. Your Legal Team will be in contact with you if this is the case.

As far as the deadline goes, right now during the pandemic, USCIS has been giving extensions on the deadlines due to the difficulty in finding documents, and various government entities may be shut down, or have reduced hours. We will also discuss this with you, and let you know if there may be an extension applied to your case.

Your Legal Team will also give you a deadline by when we will need for you to submit any additional documents we’ll need to fulfill the RFE. We do this so that your Legal Team has enough time to review your documents, conduct any additional legal research, and write a cover letter to immigration explaining the issue.
